Privacy Policy

This Privacy Policy explains how FoodPlant Pte Ltd (“FoodPlant”) processes and takes care of personal data we may collect or receive from our customers or visitors or when you visit our website at www.foodplant.com.sg (“Website”) or when you share your personal data with us, in accordance with the Personal Data Protection Act (“PDPA”). We believe that protection of personal data is important and we strive to collect only the personal data that we need.

 

1. Definition of personal data

“Personal data” refers to data, whether true or not, about an individual who can be identified from that data; or from that data and other information which we have or are likely to have access.

Depending on the nature of your interaction with us, some examples of personal data which we may collect or receive from you include name, email address, telephone number(s), residential mailing address, photographs or CCTV footage from which you can be identified.

Please note that the data protection provisions of the PDPA do not apply to business contact information, which is any contact information about you not provided by you solely for your personal purposes. Business contact information is therefore excluded from the definition of “personal data” in this Privacy Policy.

Terms used in this Privacy Policy shall have the meanings given to them in the PDPA (where the context so permits).

2. Purposes for the collection, use and disclosure of personal data

We may collect, use and disclose your personal data for any or all of the following purposes:

  1. performing obligations in the course of or in connection with our provision of the goods and/or services requested by you;

  2. responding to, handling and processing queries, requests, applications, complaints and feedback from you;

  3. managing your relationship with us;

  4. complying with any applicable laws, regulations, codes of practice, guidelines or rules, or to assist in law enforcement and investigations conducted by any governmental and/or regulatory authority;

  5. the purposes stated in the form or document used to collect the personal data, or in notice(s) around the equipment used to collect the personal data;

  6. publishing and providing you with information, newsletters or updates about completed or upcoming workshops, trainings, courses, projects or services;

  7. any other purposes for which you have provided the personal data;

  8. transmitting to any unaffiliated third parties including our third party service providers and agents, and relevant governmental and/or regulatory authorities, whether in Singapore or abroad, for the aforementioned purposes; and

  9. any other incidental business purposes related to or in connection with the above.

If you are not clear about the purposes for which your personal data is collected, used or disclosed, you may clarify with the FoodPlant staff you are liaising with or our Data Protection Officer.

3. Reliance on legitimate interests exception

In compliance with the PDPA, we may collect, use or disclose your personal data without your consent for the legitimate interests of FoodPlant or another person. In relying on the legitimate interests exception of the PDPA, FoodPlant will assess the likely adverse effects on the individual and determine whether the legitimate interests outweigh any adverse effect.

In line with the legitimate interests exception, we may collect, use or disclose your personal data for any or all the following purposes:

In compliance with the PDPA, we may collect, use or disclose your personal data without your consent for the legitimate interests of FoodPlant or another person. In relying on the legitimate interests exception of the PDPA, FoodPlant will assess the likely adverse effects on the individual and determine whether the legitimate interests outweigh any adverse effect.

  1. fraud detection and prevention;

  2. detection and prevention of misuse of services;

  3. maintenance of security of premises and facilities;

  4. detection and prevention of cyber attacks and maintenance of information security operations;

  5. sharing of data with affiliated organisation(s) for internal administration purposes.

The purposes listed above may continue to apply even in situations where your relationship with us (e.g. pursuant to a contract) has been terminated or altered in any way, for a reasonable period thereafter.

4. Withdrawal of consent

The consent that you provide for the collection, use and disclosure of your personal data will remain valid until such time it is withdrawn by you in writing. You may withdraw consent and request us to stop collecting, using and/or disclosing your personal data for any or all of the purposes listed in section 2 above by submitting your request in writing or via email to our Data Protection Officer at the contact details provided below.

We may request for additional information or document(s) for purposes of verification of identity or clarification or processing of your request.

Upon receipt of your written request to withdraw your consent, FoodPlant may require reasonable time (depending on the complexity of the request and its impact on our relationship with you) for your request to be processed and for us to notify you of the consequences of us acceding to the same, including any legal consequences which may affect your rights and liabilities to us. In general, FoodPlant will seek to process your request within 30 days of receiving it or receiving the additional information or document(s) referred to in the paragraph above, whichever is later.

Whilst we respect your decision to withdraw your consent, please note that depending on the nature and scope of your request, we may not be in a position to continue providing our goods or services to you and we shall, in such circumstances, notify you before completing the processing of your request. Should you decide to cancel your withdrawal of consent, please inform us in writing.

Notwithstanding any withdrawal of consent, FoodPlant may continue to collect, use or disclose personal data without the consent of the individual if it is required or authorised under the PDPA or any other written law.

5. Access to and correction of personal data

If you wish to make (a) a request for access to a copy of the personal data which we hold about you or information about the ways in which we use or disclose your personal data within a year before the date of your request, or (b) a request to correct or update any of your personal data which we hold about you, you may submit your request in writing or via email to our Data Protection Officer at the contact details provided below.

Please note that a reasonable fee may be charged for an access request to cover the reasonable cost of retrieving and supplying the information to you as permitted under the PDPA. If so, we will inform you of the fee before processing your request.

We may request for additional information or document(s) for purposes of verification of identity or clarification or processing of your request.

We will respond to your request as soon as reasonably possible. In general, our response will be within 30 days of receiving the request or receiving the additional information or document(s) referred to in the paragraph above or receiving payment of the access fee (where applicable), whichever is later. Should we not be able to respond to your request within said 30 days, we will inform you in writing of the time by which we will be able to respond to your request.

If we are unable to provide you with any personal data or to make a correction requested by you, we will generally inform you of the reasons why we are unable to do so (except where we are not required to do so under the PDPA).

6. Accuracy of personal data

We generally rely on personal data provided by you (or your authorised representative). In order to ensure that your personal data is current, complete and accurate, please update us if there are changes to your personal data by informing our Data Protection Officer in writing or via the email at the contact details provided below.

7. Protection of personal data

FoodPlant has reasonable security arrangements in place to protect personal data that we possess to prevent unauthorised access, collection, use, disclosure or similar risks.

You should be aware, however, that no method of transmission over the Internet or method of electronic storage is completely secure. While security cannot be guaranteed, we strive to protect the security of your information and are constantly reviewing and enhancing our information security measures.

8. Transfer of personal data outside of Singapore

FoodPlant does not transfer personal data out of Singapore. However, in the event that personal data is transferred out of Singapore, we have in place reasonable measures to ensure that any transfer of personal data out of Singapore is protected and in compliance with the PDPA.

9. Retention of personal data

FoodPlant may retain your personal data for as long as it is necessary to fulfil the purpose for which it was collected, or as required or permitted by applicable laws.

We will cease to retain your personal data, or remove the means by which the data can be associated with you, as soon as it is reasonable to assume that such retention no longer serves the purposes for which the personal data was collected, and is no longer necessary for legal or business purposes.

11. General

This Privacy Policy applies in conjunction with any other notices, contractual clauses and/or consent clauses that apply in relation to the collection, use and disclosure of your personal data by us.

We may revise this Privacy Notice from time to time without any prior notice. You may determine if any such revision has taken place by referring to the date on which this Privacy Notice was last updated. Your continued use of our services constitutes your acknowledgement and acceptance of any such changes.
